The South China Sea Arbitration

by Yoshifumi Tanaka, The South China Sea Arbitration Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download The South China Sea Arbitration book, Beyond the scope of the dispute settlement between the Philippines and China, the South China Sea arbitral award can be thought to significantly influence the development of international law and the law of the sea. Accordingly, this book seeks to examine the South China Sea arbitration from the perspective of the development of public international law and its limitations. Specifically it addresses the issues of jurisdiction of the Annex VII Arbitral Tribunal, the historic rights, the legal status of maritime features, the lawfulness of various activities of China, and the role of the South China Sea arbitration in the international dispute settlement. In considering these issues, this book examines the South China Sea arbitration in three respects: (i) the clarification of relevant rules and obligations under the UN Convention on the Law of the Sea as well as international law, (ii) the protection of community interests at sea, and (iii) considerations of time elements in international law.

The South China Sea

by Leszek Buszynski, The South China Sea Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download The South China Sea book, This book explores the very latest developments in the South China Sea maritime dispute. It examines the South China Sea as an arena for geostrategic competition between China and the United States and why the dispute is so important for regional and global geopolitics. It outlines the most recent developments in the sea itself and assesses the role of the Association of Southeast Asian Nations (ASEAN) and the current views of the contesting claimants. It considers the position of countries from outside the region, India as well as Japan; surveys military and naval developments; and examines confidence building, preventive diplomacy, and dispute resolution measures. The book concludes by highlighting the points of greatest risk and by discussing how the situation is likely to develop going forward.

Total Competition

by Patrick M. Cronin, Total Competition Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download Total Competition book, China’s bid for ascendancy remains anchored in the South China Sea and surrounding Southeast Asian countries. This report argues that China is waging total competition in the South China Sea. Beijing’s campaign of total competition, like George Kennan’s concept of “political warfare,” involves the use of all tools at the state’s disposal short of war. Total competition differs from ordinary competition in its virtually unrestricted execution. It includes illegitimate and destabilizing methods that are ordinarily avoided by benign competitors. China’s total competition or political warfare campaign has five essential pillars: economic power, information dominance, maritime power, psychological warfare, and “lawfare.”

World Economic Outlook October 2016

by International Monetary Fund. Research Dept., World Economic Outlook October 2016 Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download World Economic Outlook October 2016 book, According to the October 2016 "World Economic Outlook," global growth is projected to slow to 3.1 percent in 2016 before recovering to 3.4 percent in 2017. The forecast, revised down by 0.1 percentage point for 2016 and 2017 relative to April’s report, reflects a more subdued outlook for advanced economies following the June U.K. vote in favor of leaving the European Union (Brexit) and weaker-than-expected growth in the United States. These developments have put further downward pressure on global interest rates, as monetary policy is now expected to remain accommodative for longer. Although the market reaction to the Brexit shock was reassuringly orderly, the ultimate impact remains very unclear, as the fate of institutional and trade arrangements between the United Kingdom and the European Union is uncertain. Financial market sentiment toward emerging market economies has improved with expectations of lower interest rates in advanced economies, reduced concern about China’s near-term prospects following policy support to growth, and some firming of commodity prices. But prospects differ sharply across countries and regions, with emerging Asia in general and India in particular showing robust growth and sub-Saharan Africa experiencing a sharp slowdown. In advanced economies, a subdued outlook subject to sizable uncertainty and downside risks may fuel further political discontent, with anti-integration policy platforms gaining more traction. Several emerging market and developing economies still face daunting policy challenges in adjusting to weaker commodity prices. These worrisome prospects make the need for a broad-based policy response to raise growth and manage vulnerabilities more urgent than ever.

The Rise Of China And International Law

by Congyan Cai, The Rise Of China And International Law Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download The Rise Of China And International Law book, The rise of China signals a new chapter in international relations. How China interacts with the international legal order--namely, how China utilizes international law to facilitate and justify its rise and how international law is relied upon to engage a rising China--has invited growing debate among academics and those in policy circles. Two recent events, the South China Sea Arbitration and the US-China trade war, have deepened tensions. This book, for the first time, provides a systematic and critical elaboration of the interplay between a rising China and international law. Several crucial questions are broached. These include: How has China adjusted its international legal policies as China's state identity changes over time, especially as it becomes a formidable power? Which methodologies has China adopted to comply with international law and, in particular, to achieve its new legal strategy of norm entrepreneurship? How does China organize its domestic institutions to engage international law in order to further its ascendance? How does China use international law at a national level (in the Chinese courts) and at an international level (for example, lawfare in international dispute settlement)? And finally, how should "Chinese exceptionalism" be understood? This book contributes significantly to the burgeoning and highly relevant scholarship on China and international law.

Netherlands Annual Review Of Military Studies 2017

by Paul A.L. Ducheine, Netherlands Annual Review Of Military Studies 2017 Books available in Docs, PDF, EPUB, Mobi, Textbook, Kindle Format. Download Netherlands Annual Review Of Military Studies 2017 book, International conflict resolution increasingly involves the use of non-military power and non-kinetic capabilities alongside military capabilities in the face of hybrid threats. In this book, counter-measures to those threats are addressed by academics with both practical and theoretical experience and knowledge, providing strategic and operational insights into non-kinetic conflict resolution and on the use of power to influence, affect, deter or coerce states and non-state actors. This volume in the NL ARMS series deals with the non-kinetic capabilities to address international crises and conflicts and as always views matters from a global perspective. Included are chapters on the promise, practice and challenges of non-kinetic instruments of power, the instrumentality of soft power, information as a power instrument and manoeuvring in the information environment, Russia's use of deception and misinformation in conflict, applying counter-marketing techniques to fight ISIL, using statistics to profile terrorists, and employing tools such as Actor and Audience Analysis. Such diverse subjects as lawfare, the Law of Armed Conflict rules for non-kinetic cyber attacks, navigation warfare, GPS-spoofing, maritime interception operations, and finally, as a prerequisite, innovative ways for intelligence collection in UN Peacekeeping in Mali come up for discussion. The book will provide both professionals such as (foreign) policy makers and those active in the military services, academics at a master level and those with an interest in military law and the law of armed conflict with useful and up-to-date insights into the wide range of subjects that are contained within it. Paul A.L. Ducheine and Frans P.B. Osinga are General Officers and full professors at the Faculty of Military Sciences of the Netherlands Defence Academy in Breda, The Netherlands.
