The legality and legitimacy of essential case law insufficiently reflects the inadequate handling of the decision-making responsibility of the judiciary in democratic countries. The creation of judicial precedent and its respective methodology are correspondingly characterized by poor transparency as well as by a virtually comprehensive but partially unnecessary complexity. Against this background, Pedro S.d.M. Aleixo has drafted a model of prescriptive model of judicial precedent, which transparently presents the necessary distribution of responsibility for judicial precedent. Through a responsibility-oriented distinction between interpretation and legislation, the interpretation through the judiciary becomes more objective and precedent becomes easier to manage. Mit der entscheidungstreffenden Verantwortung der Judikative wird auch in demokratischen Rechtsstaaten unangemessen umgegangen, die rechtliche Zulassigkeit und Legitimitat des massgeblichen Richterrechts meistens nur unzureichend reflektiert. Die richterliche Rechtsgewinnung und ihre jeweiligen Methodiken zeichnen sich demgemass aus durch mangelnde Transparenz sowie nahezu flachendeckende, aber z.T. entbehrliche Komplexitat. Vor diesem Hintergrund entwirft Pedro S. d. M. Aleixo ein Modell praskriptiver richterlicher Rechtsgewinnungsmethodik, welches die bei der richterlichen Rechtsgewinnung erforderliche Verantwortungsverteilung transparent darstellt. Durch eine verantwortungsbezogene Unterscheidung von Auslegung und Rechtsetzung wird die Auslegung durch den Richter objektiver und die Rechtsgewinnung insgesamt einfacher handhabbar.
